DISPUTE RESOLUTION
General To resolve disputes efficiently and cost-effectively, you and Cosmic Operations agree to binding arbitration for any disputes related to these Messaging Terms or your receipt of text messages. Arbitration is less formal than court proceedings, using a neutral arbitrator instead of a judge or jury, and has limited discovery and court review. This agreement includes all claims, regardless of the legal theory, and you waive the right to a jury trial or class action.
Exceptions Nothing in these Terms limits your or Cosmic Operations’ rights to:
- Bring an individual action in small claims court.
- Pursue enforcement through applicable federal, state, or local agencies.
- Seek injunctive relief from a competent court.
- Address intellectual property infringement claims in court.
Arbitrator Any arbitration will be governed by the Federal Arbitration Act and the AAA’s Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer-Related Disputes (collectively, “AAA Rules”), administered by the American Arbitration Association (AAA). The arbitrator will have exclusive authority to resolve any disputes regarding this arbitration agreement.
Notice and Process If you or Cosmic Operations intends to seek arbitration, the initiating party must send a written notice of the dispute (“Notice”) via U.S. Mail.

Both parties will attempt to resolve the claim directly within 30 days of receiving the Notice; if unresolved, arbitration may commence.
Fees If you initiate arbitration, Cosmic Operations will reimburse your filing fee unless your claim exceeds $15,000, in which case fees will be decided by the AAA Rules. For claims of $15,000 or less, you may choose the format of the arbitration (documents only, phone hearing, or in-person). If the arbitrator finds your claim frivolous, you agree to reimburse Cosmic Operations for fees incurred.
Confidentiality All arbitration-related information will be kept confidential, except as necessary for enforcement or limited judicial review. The arbitrator may rule on fees and expenses at any time during the process.
No Class Actions You and Cosmic Operations agree to bring claims only in individual capacities, not as part of a class or representative action. Claims cannot be consolidated, and the arbitrator cannot preside over any representative or class proceeding.
Modifications If Cosmic Operations changes this arbitration provision (other than the Notice address), you can reject the change by notifying Cosmic Operations in writing within 30 days.
Enforceability If a court finds any part of these Terms unenforceable, the remaining provisions will stay in effect.
CHANGES TO MESSAGING TERMS
Cosmic Operations reserves the right to modify or terminate the messaging program and these Messaging Terms at any time. Changes will take effect immediately upon posting, and your continued enrollment constitutes acceptance of those changes.
